Used Car Buying Guide - Californian Lemon Law Explained

The lemon law in California is slightly different, depending on whether you are buying a used car or a new car. You are covered by the Californian lemon law if the car comes with an express, written warranty. This is basically the seller or manufacturer's written promise to repair or replace defective parts for a stated period of time.

In theory if you buy a used car in California you are legally entitled to have the defects repaired or a replacement given as long as you have the aforesaid warranty. However you could still be charged for use prior to the defect arising. This charge is not easy to calculate as there is no set formula as there is with new vehicles.

If a repair is necessary or the car needs to be replaced you are legally covered by the Californian lemon law as long as you have the appropriate warranty. You could still be charged for usage before you pointed out the faults and unfortunately this charge is not easy to calculate as there is no formula from which to work out a figure.

* Always run a check on the car on make sure that the dealer is being honest about the history of the car.

* If there is no warranty offered with the vehicle BEWARE. It is probably a ringer.

* You deserve a warranty with a used car. Read the document carefully to make sure it offers decent, fair guarantees.

* Make sure you have an independent check done by a certified mechanic. Documental evidence is very useful.

* Give yourself the chance to find any faults by taking the car for a drive. Make sure you take enough time to let the car warm up as there are plenty of ways to hide faults for a short period.

* There is nothing worse than a dealer using high pressure tactics to make a sale. If he starts doing this be strong and politely leave. You are under no obligation to stay.
